Statutory compliance refers to the act of adhering to all applicable federal, state, and local laws, statutes, ordinances, and regulations. For Homeowners Associations (HOAs), this concept is paramount, forming the legal bedrock upon which the community operates. It ensures that all decisions, actions, and policies undertaken by the HOA board of directors and management are lawful, protecting both the association as a legal entity and its individual members. Ignoring statutory requirements can lead to severe consequences, including legal challenges, financial penalties, invalidation of board actions, and a loss of credibility within the community.

In the HOA context, statutory compliance encompasses a broad spectrum of legal obligations. At the federal level, HOAs must comply with acts such as the Fair Housing Act (FHA) and the Americans with Disabilities Act (ADA), which prohibit discrimination and mandate accessibility. State laws are particularly crucial, often dictating specific requirements for common interest developments through acts like California’s Davis-Stirling Act, Florida’s Condominium Act, or similar statutes in other states. These state laws typically govern areas such as board elections, meeting procedures, financial reporting, reserve study requirements, assessment collection, and member rights. Additionally, local ordinances related to zoning, building codes, and permits also fall under the umbrella of statutory compliance, ensuring the HOA operates within municipal guidelines.

Maintaining statutory compliance requires ongoing vigilance and proactive measures. HOA boards have a fiduciary duty to understand and uphold these laws, often relying on expert legal counsel and professional management to navigate complex legal landscapes. Regular review of governing documents against current laws, board education, transparent record-keeping, and consistent application of rules are essential practices. Failure to comply can result in expensive litigation, fines, damage to the association’s reputation, and even personal liability for board members in certain circumstances. By prioritizing statutory compliance, HOAs safeguard their assets, foster fair and consistent governance, and contribute to the overall stability and well-being of the community they serve.
